These General Terms of Use ("Terms") govern access to and use of the Orilyt platform (the "Service"), accessible at orilyt.com, published by Jean-Benoît Kauffmann, trading as JBK Agency.
By creating an account or using the Service, the user ("User") accepts these Terms in full. If you do not agree, you must not use the Service.
The Publisher reserves the right to modify these Terms at any time. Users will be notified of significant changes by email or in-app notification. Continued use after notification constitutes acceptance of the updated Terms.
Orilyt is a SaaS platform that performs automated audits of websites. The Service includes: automated technical, SEO, security, performance and accessibility checks; report generation; monitoring and alerts; quote generation; prospecting tools; and REST API access.
Audits are performed via read-only HTTP requests to publicly accessible URLs. Orilyt does not modify, access private areas of, or store copies of the audited websites.
Results reflect the state of the website at the time of the audit and depend on factors outside the Publisher's control (server availability, network conditions, website configuration). The Publisher does not guarantee that all issues will be detected or that results are exhaustive.
To access paid features, the User must create an account by providing a valid email address and a password. The User guarantees that the information provided is accurate and up to date.
The User is solely responsible for maintaining the confidentiality of their credentials. Any activity performed under their account is deemed to have been performed by the User. The User must notify the Publisher immediately of any unauthorized use.
The Publisher reserves the right to suspend or delete any account that appears to be fraudulent, inactive for more than 12 months, or in violation of these Terms.
The Service is available in several plans (Free, Solo, Pro, Agency, Business) described on the pricing page. The Publisher reserves the right to modify prices and features at any time. Active subscriptions will not be affected until their next renewal.
Payments are processed by Stripe, Inc. under their own terms of service. The Publisher does not store credit card numbers. All prices are displayed in euros and exclusive of VAT where applicable.
Subscriptions are billed monthly or annually. The User may cancel at any time from their account settings. Cancellation takes effect at the end of the current billing period. No pro-rata refund is issued for the remaining period.
Credit packs are one-time purchases, valid for 12 months from the date of purchase. Unused credits expire and are not refundable.
In accordance with Article L221-28 of the French Consumer Code, the right of withdrawal does not apply to the supply of digital content or digital services the performance of which has begun with the consumer's prior express consent and their acknowledgement that they thereby lose their right of withdrawal.
The User agrees to use the Service in compliance with applicable laws and these Terms. The following uses are strictly prohibited:
The Service includes prospecting tools (audit, email sending, quote generation). The User is solely responsible for compliance with applicable regulations when contacting prospects, including GDPR (EU), CCPA (US), and any local anti-spam laws.
The User guarantees that they have a legitimate interest or prior consent to contact each prospect. The Publisher cannot be held liable for the User's non-compliance with email marketing regulations.
Prospect reports are restricted views designed for commercial outreach. They do not constitute a complete or binding assessment of the audited website.
The Service, its source code, algorithms, design, brand, logos, documentation and all associated content are the exclusive property of the Publisher and are protected by intellectual property laws.
The User receives a personal, non-exclusive, non-transferable license to use the Service for the duration of their subscription. This license does not grant any right over the source code or technology.
Audit reports generated by the Service may be shared with third parties (clients, prospects) under the User's responsibility. White-label customization is permitted within the scope of the subscribed plan.
The Service is provided "as is" and "as available". The Publisher makes no warranty, express or implied, regarding the accuracy, completeness, reliability or fitness for a particular purpose of audit results.
To the maximum extent permitted by applicable law, the Publisher's total liability for any claim arising from or related to the Service shall not exceed the amount paid by the User during the 12 months preceding the claim.
The Publisher shall not be liable for: (a) indirect, incidental, special or consequential damages; (b) loss of revenue, profits, data or business opportunities; (c) actions taken by the User based on audit results; (d) unavailability of the Service due to force majeure, maintenance, or third-party service failures.
The User acknowledges that audit results are indicative and do not replace a comprehensive manual security audit or professional assessment. Decisions based on Orilyt reports are taken at the User's sole risk.
The Publisher endeavors to maintain the Service available 24/7 but does not guarantee uninterrupted access. Scheduled maintenance, updates, and unforeseen incidents may cause temporary downtime.
The Publisher shall not be liable for any loss resulting from service interruptions, whether planned or unplanned.
The processing of personal data is governed by the Privacy Policy, accessible at orilyt.com/privacy. By using the Service, the User acknowledges having read and accepted the Privacy Policy.
The User may terminate their account at any time from account settings. Termination takes effect immediately for free accounts, or at the end of the current billing period for paid subscriptions.
The Publisher may suspend or terminate a User's account without notice in case of: violation of these Terms; abusive use; non-payment; or any activity that threatens the security or integrity of the Service.
Upon termination, the User's data will be retained for a maximum of 90 days, after which it will be permanently deleted. The User may request data export before termination via the GDPR export feature.
The Publisher shall not be held liable for any failure or delay in performing its obligations where such failure or delay results from circumstances beyond its reasonable control, including but not limited to: natural disasters, government actions, internet failures, hosting provider outages, cyberattacks, pandemics, or energy crises.
These Terms are governed by French law. Any dispute arising from or related to these Terms shall be submitted to the exclusive jurisdiction of the courts of Melun (France), unless mandatory consumer protection rules require otherwise.
In accordance with Article L612-1 of the French Consumer Code, the User is informed that they may resort to conventional mediation in the event of a dispute. The designated mediation service is available at: https://www.economie.gouv.fr/mediation-conso.
